The eligibility criteria to appear in the Indian Patent Agent Exam are as follows:

  • Candidate shall be a citizen of India and have completed 21 years of age; and
  • Has obtained a degree or is in the final year of a degree in Science, Engineering or Technology, from any University.

Examination Pattern and Certification

Qualifying Patent Agent Examination involves two steps:

Step 1 - Written Examination,

The written examination consists of two papers:

Paper I – Patent Act and Rules.

This is a 100 Marks paper which has objective type questions. The maximum time allowed for this paper is 2 Hours.

Paper II- Drafting and interpretation of Patent Specification and other documents.

This paper is also for 100 Marks with questions requiring descriptive answers. The maximum time allowed for this paper is 3 Hours.

Step 2 - Viva-Voce

Schedule for Viva-Voce examination will be announced after the completion of the written examination. Only those candidates who have scored a minimum of 50% marks in each paper will be allowed to appear for the Viva-Voce. A separate list for the same would be provided.

On successful completion of the above two steps, candidates will get a certificate and a membership number from the Indian Patent Office.
